This website is operated by Udipi’s Upahar, a unit of Guruappa Hotels Pvt. Ltd. Throughout the site, the terms “we”, “us” and “our” refer to Udipi’s Upahar . Udipi’s Upahar offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. By visiting our website and/or restaurant and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content. Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service. Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

  1. The Udipi’s Upahar website is specially designed for customers who place orders through the Udipi’s Upahar website for specifies Udipi’s Upahar outlets mentioned in the website.

    (a) Udipi’s Upahar website viz. www.udipisupahar.com; and/or (b) Udipi’s Upahar mobile site viz. m.udipisupahar.com

  2. The acceptance of order shall be at the entire discretion of Udipi’s Upahar.

  3. It is clarified that the online service is not available at all Udipi’s Upahar outlets of India.

  4. To check whether Online service of Udipi’s Upahar is available in your area, customers need to :

    • call the Udipi’s Upahar restaurant at +91 7093601421; and/or
    • log on to Udipi’s Upahar website viz. www.udipisupahar.com; and/or
    • check the Udipi’s Upahar mobile site viz. m.udipisupahar.com
  5. Udipi’s Upahar reserves the right, in its sole discretion, without limitations, conditions and/or qualifications, and without need of prior notification, to limit, change, modify or cancel any order, and/or to refuse any service to any customer for any reason attributable to the unavailability of the items ordered, or other circumstances and conditions beyond the control of Udipi’s Upahar which would render impossible or delay the fulfilment of its obligations.

  6. Udipi’s Upahar reserves the right to refuse or to accept or to cancel any order from any customer beyond the delivery area or otherwise.

  7. All products at Udipi’s Upahar are subject to availability.

  8. In-Store Order/ Dine in - This service allows customers to use the Udipi’s Upahar website to skip the queue at the counter to place their order to dine-in directly on their phones. Customers must place their order only when they're physically present in the restaurant.

  9. Pick up - This service allows customers to use the Udipi’s Upahar website to skip the queue at the counter to place their order for take away. The food will be packed and packaging charges will be levied on the customer. The customer has the option of going eco-friendly and chose to bring his/her own containers/utensils to pick the food up. Customers can use the Udipi’s Upahar website to order in advance from a store which is on their travel route or nearest to them. Orders for pickup need to be placed minimum 30 minutes in advance. Upon the customer’s arrival in the restaurant, he/she must inform the designated crew member the order number so that the designated crew member can deliver their order.

  10. Delivery - This service allows customers to use the Udipi’s Upahar website to place an order that will be delivered to the address mentioned by the customer on the Udipi’s Upahar website. Delivery charges and packaging charges will be levied on the customer.

  11. Delivery orders are subject to:

    • Customer addresses falling in the delivery area (area within which Udipi’s Upahar Delivery is available) of the nearest restaurant. The delivery area is defined from time to time by Guruappa Hotels Pvt. Ltd. at its discretion and is subject to change.
    • The delivery address being mapped to the nearest restaurant that delivers in customer area.
    • Availability of Udipi’s Upahar’s products.
    • In case the delivery locality is not listed in the restaurant map, delivery orders cannot be placed.
  12. Once the order has been placed it cannot be changed by the customers for any reason. In case, the customer wants to add more products to the cart, he/she must place a new order for the required products.

  13. It is the responsibility of the customers, who opt for Pick-up, to ensure that there is no discrepancy in the bill and products given to them at the time of pickup. In case the customer chooses not to check and after reaching their home, finds that product(s) given to him/her are wrong/missing, it will be not be the responsibility of Udipi’s Upahar restaurant.

  14. In the case of wrong product being delivered/ given : - Dine in – The wrong product will be replaced with the right one. No refund will be issued. - Take away – The wrong product will be replaced with the right one. No refund will be issued. - Delivery – Exact amount charged for the wrong product will be refunded upon proof (picture of the wrong product) submitted to the restaurant. The wrong product will not be replaced with the right one. If the customer still wishes to receive the required product, he/she must place a new order. The decision is at the discretion of the Management at Udipi’s Upahar and is subject to change.

  15. In the case of product(s) not being delivered to customer/ any product missing –

    • Dine in – Missing product will be given to the customer upon being intimated to Udipi’s Upahar Service Associates/ supervisors/ Manager.
    • Takeaway - Missing product will be given to the customer upon being intimated to Udipi’s Upahar Service Associates/ supervisors/ Manager.
    • Delivery – Customers are requested to get in touch with the outlet manager at +91 7093601421 upon which a refund will be initiated for the missing product only. The decision is at the discretion of the Management at Udipi’s Upahar and is subject to change.
  16. The price of Udipi’s Upahar’s products are exclusive of delivery charges and packing charges. The customer is liable to pay delivery charges and packing charges as applicable plus GST as may be applicable from time to time.

  17. Udipi’s Upahar shall use its best efforts to meet the scheduled delivery time conveyed by the Udipi’s Upahar website on the phone to the customer, however, it does not guarantee these delivery timelines in every case. Udipi’s Upahar shall not have any liability to customer if the customer's order fails to meet in whole or in part such scheduled delivery time.

  18. It is customer’s responsibility to ensure that customer himself/herself or an appropriate person is available at the delivery address and he/she must pay in full for the order placed through Udipi’s Upahar website. If customer or appropriate person fails to be present for receiving the delivery, Udipi’s Upahar is entitled to charge the customer in full the amount of order and the cost of delivery

  19. While placing the order on the Udipi’s Upahar website www. udipisupahar.com, customers may choose the online payment option, upon which they shall be redirected to an external payment gateway, on which they are required to follow the payment gateway’s separate instructions for effecting online payment. The payment gateway is not under Udipi’s Upahar’s control, and Udipi’s Upahar is not responsible for and shall not be liable to any extent or in any manner for any payment-related or internet-related issues faced by customers in relation to online payments including payment refunds, and customers shall indemnify and keep fully and effectively indemnified Udipi’s Upahar and its affiliates in this regard.

  20. It shall be the responsibility of the customer to ensure that delivery instructions are clear and concise.

  21. Udipi’s Upahar reserves the right to reject the Service/Delivery order or to cancel the same once it is accepted: a. In case Udipi’s Upahar is unable to contact the customer due to any reason whatsoever on the mobile / landline number of the customer as provided by the customer at the time of placing the order. b. In case of non-receipt of payment in full or in part in any previous order. c. In case of abuse to any employee/ representative /riders of Udipi’s Upahar in any previous incident. d. If there is a trend of order cancellations. e. If there is a trend of frequent complaints and consequent replacements. f. If customer has provided wrong, inaccurate, incomplete or incorrect address. g. If customer’s address is not falling in defined delivery area of the nearest or any other restaurant or beyond the delivery area of Udipi’s Upahar. h. In view of difficult operating conditions for Udipi’s Upahar like heavy traffic or bad weather condition or New ’Year’s eve, during Ganesh festival, Christmas and Navratri, political rallies etc. i. In any other event at the sole discretion of Udipi’s Upahar, without the need to assign any reason or explanation.

  22. Udipi’s Upahar may change the terms of, or add new terms to, these Terms and Conditions at any time, with or without cause, and without giving notice.

  23. Udipi’s Upahar reserves the right to send to the customers registered with Udipi’s Upahar, promotional electronic mails and Short Message Service (SMS) though the mobile numbers of such customers may be registered with the DND (Do Not Disturb) services.

  24. By registering on the Udipi’s Upahar website, you allow Udipi’s Upahar to contact you for offers and updates relating to your account.
